Set-up & Preparation

  1. The Owner acknowledges that various types of equipment (i.e., lifts, booms, excavators, Bobcats, etc.) will be used at the property to carry out the work, and that the Owner will be responsible for the removal of all fences, decks, landscaping, and any other structures or installations that require removal to use such equipment, at their expense, unless otherwise agreed upon in writing.
  2. In the event that any damage occurs to driveways, lawns, shrubs, walkways, gardens, trees, siding, deck, fence, or any other installations, the liability of G1000 Home Substructure shall be limited to the repair of the directly affected area(s) only.
  3. The Owner agrees that G1000 Home Substructure is not responsible for and will be held harmless against any water intrusion and damage to the property outside the scope of work originally contracted for, including but not limited to, homeowner negligence or lack of maintenance to the property.
  4. All materials remain the property of G1000 Home Substructure until such time as all amounts due herein are paid in full.
  5. In the event that it is necessary for G1000 Home Substructure to commence legal and collection proceedings, the Owner shall be responsible for all legal fees, court costs, and other costs incurred by G1000 Home Substructure in the course of enforcing the terms of this agreement. All legal costs shall be payable on a substantial indemnity basis.
  6. The Owner hereby authorizes the balance owing to be charged to the credit card referred to on the authorization form in the event that payment is not remitted in accordance with the terms herein.
  7. The Owner acknowledges that any NSF charges incurred by G1000 Home Substructure for cheque payments will result in a $75 administration charge on top of the balance owing.
  8. The Owner acknowledges and confirms that this Agreement constitutes the entire agreement between the parties and supersedes all prior and contemporaneous agreements, understandings, and discussions, whether oral or written, and that there are no representations, warranties, collateral agreements, conditions, promises, or understandings affecting this Agreement, or supported hereby, other than as expressed herein in writing.
  9. Where this Agreement has been executed by more than one person, the liability of the persons executing this Agreement shall be joint and several and every reference in this Agreement to the “Owner” shall be construed to mean each person who has executed it as well as all of them. This Agreement is binding on those who have executed it notwithstanding that it may remain unexecuted by any other person.
  10. This Agreement shall be construed in accordance with the laws of the Province of Ontario. This Agreement shall endure to be binding upon the Owner, his/her heirs, executors, administrators, and assigns.
  11. G1000 Home Substructure has a liability insurance with a specific for underpinning/waterproofing and carries Workers Compensation.
  12. We carry specific underpinning insurance, as this is not covered by general liability insurance. Any contractor quoting this project must have this insurance add-on.
  13. We cannot account for things like compromised soil under the floor, contaminated soil (old oil leaks), underground obstructions like large boulders, and buried utilities.
  14. If the excavation takes us below the sewer pipes, we must add a sewage ejector to the price. If we hit a higher than normal water table, we must have an engineer visit and assist with a stamped plan of action to dewater so we can continue working. We cannot account for the amount of engineer visits in this pricing.

 

When Work Commences

  1. Once you have decided to proceed with the contract you have, please call 416-992-6434 or email g1000home@gmail.com. We require a signed copy of the contract in an email, in person, or a text photo from your sales representative.
  2. Once you have provided us with the go-ahead and the signed contract, we will arrange to take a deposit to secure the order and put you in the queue. We take a minimum deposit of 10 percent of the contract price. Deposits are mandatory to book the start of work; without a deposit, we are not going to order locates or book/reserve installation dates.
  3. We accept cheques, VISA or MasterCard, etransfer, or cash, All credit cards can be called in directly to the office.
  4. FOR INTERIOR PROJECTS: Once a deposit is taken, the project will be scheduled as soon as possible or at the agreed-upon date.
  5. FOR EXTERIOR PROJECTS: waterproofing, excavation, underpinning etc. Once a deposit is taken, we will book our locate (i.e. gas locates, hydro locates, other utilities) through Ontario One Call. These locates are mandatory, and it is against the Ministry of Labour rules to execute any excavation without it. Feel free to browse their website for more about the rules and fines associated with digging without locates. Fines can reach thousands of dollars to both the contractor and homeowner. Locates are critical in preventing major incidents with utilities (i.e. cutting telecom services, hitting gas lines causing explosions or hydro lines, etc.)
  6. Ordering and receiving a locate generally takes seven to ten business days (timing is out of our control), Once we have the locates, work will commence. Sometimes, depending on the weather, locates take longer than expected (up to 2-3 weeks). However, be assured we will be working to push it as fast as we can to get the work done efficiently and safely.
  7. Once all locate tickets are in hand, our office will notify you of the work start date. Once the work has commenced, you will have the progress payments made ready at the time stated on the contract.
  8. We expect to be paid on completion of the work. Before the job is completed, our sales staff will provide direct instructions as to who is authorized to collect payment. Once the balance of the contract is executed and paid for, the warranty will then be in effect. You will be sent a final invoice along with your warranty certificate.
  9. If the work is completed on the exterior of the house, it will require a minimum of three months of settlement before any landscaping is allowed to be completed. Note: We do not reinstall landscaping or patio stones or any structure.
  10. If the work is completed from the interior of the home, you have to allow a minimum of thirty days for the concrete to dry. You cannot replace walls, rebuild, or replace the floor in the repair area within this minimum timeframe to ensure your warranty is in full effect. Note: we do not reinstall interior finishes.
  11. Warranty issues will be dealt with immediately. You must notify the G1000 Home Substructure main office within twenty-four hours of discovery so we can assess if the issue is from the same repair area.

 

Responsibility and Agreement Terms
